|SETTLEMENT OF CLASS ACTION AGAINST ENGLISH MONTREAL SCHOOL BOARD AND RENWICK SPENCE|
MONTREAL, OCTOBER 11, 2013- The Québec Superior Court of Justice has approved a settlement of the class action against the English Montreal School Board (EMSB), as successor to the Protestant School Board of Greater Montreal (PSBGM), and Renwick Spence, a former teacher at the Montreal West High School. This agreement was reached following a settlement conference presided by the Honourable Justice Michel Caron of the Québec Superior Court and attended by the parties and/or their representatives.
The settlement provides for payment of up to $5 million to settle all claims, depending on the number of admissible claims filed, of former students of Montreal West High School who allege they were sexually assaulted by Spence. The settlement provides for a streamlined, discreet and confidential claims process.
The Class Representative Sebastian and the Class members are represented by the law firms of Lauzon Bélanger Lespérance and Trudel & Johnston.
Commencing immediately, claimants may submit their claims for compensation. Claims
The class action was authorized by the Québec Superior Court in 2007. A pseudonym order was issued by the Court, preventing publication of the identity of the Class Representative, Sebastian. A Court order was also issued for the preservation of the confidentiality of Class members’ identities.
In the settlement, the EMSB, as successor to the PSBGM, does not make any admission of liability with respect to the abuse committed by Spence. That said, the EMSB does not deny that Spence sexually abused some students who attended Montreal West High School from the 1960s to the early 1980s.
The EMSB, as successor to the PSBGM, sincerely and profoundly apologizes to those students and their families whose lives have been affected by the abuse they endured and hopes that the settlement will in some way help with each victim’s healing process.
